7. Contract description
The services to be provided include the supervision of the works for the first phase of a waste stabilisation pond system, comprising pre-treatment and anaerobic primary treatment, for the treatment of wastewater in Vlore, the connection with the initial pumping station, bar screen, ventury flow meter, grit chamber/splitting box and electromechanical associated works. The Consultant will provide a typical design for house connections and also ensure the supervision of the house connections to the existing sewer collection network.

10. Scope for additional services
If delays occur as a result of unforeseen circumstances namely linked to the works contract, the Contracting Authority reserves the right to extend the contract for additional services consisting in the repetition of similar services entrusted to the contractor under the first contract. The additional funds would come from the same budget line used for the initial contract and, in any case, cannot exceed 50% of the value of the principal contract.


CONDITIONS OF PARTICIPATION
11. Eligibility
Participation in tendering for supply of services is open on equal terms to all natural and legal persons of the EU Member States of the European Union, accession countries ( Bulgaria, Croatia and Romania), Turkey, and of the beneficiary countries of the CARDS programme ( Albania, former Yugoslav Republic of Macedonia, Bosnia-Herzegovina, and Serbia-Montenegro). All services must originate in one or more of these countries.
12. Candidature
All eligible natural and legal persons (as per item 11 above) or groupings of such persons (consortia) may apply.
A consortium may be a permanent, legally-established grouping or a grouping which has been constituted informally for a specific tender procedure. All members of a consortium (ie, the leader and all other partners) are jointly and severally liable to the Contracting Authority.
The participation of an ineligible natural or legal person (as per item 11) will result in the automatic exclusion of that person. In particular, if that ineligible person belongs to a consortium, the whole consortium will be excluded.
13. Number of applications
No more than one application can be submitted by a natural or legal person (including legal persons within the same legal group), whatever the form of participation (as an individual legal entity or as leader or partner of a consortium submitting an application). In the event that a natural or legal person (including legal persons within the same legal group) submits more than one application, all applications in which that person (and legal persons within the same legal group) has participated will be excluded.
14. Shortlist alliances prohibited
Any tenders received from tenderers comprising firms other than those mentioned in the short-listed application forms will be excluded from this restricted tender procedure. Short-listed candidates may not form alliances or subcontract to each other for the contract in question.
15. Grounds for exclusion
As part of the application form, candidates must submit a statement to the effect that they are not in any of the exclusion situations listed in Section 2.3.3 of the Practical Guide to contract procedures financed from the General Budget of the European Communities in the context of external actions (available from following Internet address: http://europa.eu.int/comm/europeaid/index_en.htm (http://europa.eu.int/comm/europeaid/index_en.htm)).

On the basis of the applications received, at least 4 and at most 8 candidates will be invited to submit detailed tenders for this service contract.

The Contract title and the Publication reference (see item 1 above) must be clearly marked on the envelope containing the application and must always be mentioned in all subsequent correspondence with the Contracting Authority.
