Post: legal expert supporting the creation of the regulatory framework for the operation of e-GIF
Location: NAIS office, Tirana, Albania
Duration: maximum 20 working days
Period: 15th February – 15th October 2011

Background
Albania is committed to joining the EU and is in the process of undertaking the necessary reforms required to be compliant with European standards. At the end of 2009 a technical assistance project aiming to define the fundamental principles of building an e-Government architecture was launched with the resulting document “Feasibility Study on Interoperability Framework for Government of Albania”. This feasibility study summarized the situation of e-services, the IT background at various government institutions and legal regulations. It provided recommendations regarding a high-level system architecture for a possible interoperability layer, recommendations on the usable standards, and some considerations for implementation and operations phases.

Based on these developments the Government of Albania initiated, within the Annual Action Programme 2009 of the Instrument for Pre-accession Assistance, a technical assistance project, Building an e-Government infrastructure in line with EU personal data protection standards, with the general aim of creating an interoperability framework for activities that will be developed in the future. As result of tendering process a contract was signed with a Hungarian management consultancy company, the AAM Consulting Ltd. The specific objective of this contract is to support the National Agency for Information Society (NAIS) in the development of e-Government infrastructure in line with EU Personal Data Protection standards.

Requested services
The expert is expected to support NAIS in the creation the regulatory framework for the operation of e-GIF (e-government interoperability framework). [scope of the assignment]
The expert has to take part in the following activities relating to the scope of the assignment:

• Legal gap analysis, summary of the regulatory needs
o Collecting relevant Albanian regulations in force
o Identifying those elements of the relevant Albanian regulations in force, which need to be modified or amended
o Participation in roundtables

• Creation of the regulatory concept
o Defining how relevant Albanian regulations in force need to be modified or amended
o Participation in roundtables

• Creation of draft legal acts
o Creating draft legal acts and explanatory documents
Required outputs

• Legal gap analysis and summary of regulatory needs relating to the scope of the assignment
• Regulatory concept relating to the scope of the assignment
• Draft legal acts and explanatory documents relating to the scope of the assignment

The expert should elaborate these documents in cooperation with other members of the expert-team according to the relevant EU requirements in the proper EU format, as required by the EU delegation.

Profile required of the expert
The expert must demonstrate through its CV the following qualifications, knowledge and professional capacity:

Professional qualifications
Albanian university degree in law is required. Knowledge about ICTs is advantage.

Work experience
At least 3-5 years work experience. Experience in e-government related regulation and in regulatory drafting (codification) is preferred. Experience in working with or within public administration is advantage. Experience in legal research is advantage. Knowledge of EU practices is preferred.

Language skills
Fluency in Albanian is required.
Fluency in English is required. Knowledge of other EU official language is advantage.

Other skills
Proficiency in using office applications (e.g. MS Word, MS PowerPoint) is required.

Multiple applications
Applicants do not have to submit multiple applications if they also would like to apply for other short-term legal expert positions in relation to development of e-Government infrastructure in line with EU Personal Data Protection standards. In this case the interest has to be indicated in the application, however experts can receive maximum two assignments.

Exclusion
Experts employed by the Albanian public administration cannot be recruited for the short-term legal expert positions, unless prior written approval has been obtained from the European Commission.
