CONTRACT SPECIFICATIONS


6. Description of the contract
The subject of the contract is:
a) the manufacture, delivery, installation, commissioning, maintenance and training by the Contractor of the following goods:
§ A new Desalter Unit as specified in the tender dossier, Annex II ”Technical Specifications”;
§ Equipment for the upgrade of Waste Water Treatment Plant (WWTP) as specified in the tender dossier, Annex II ”Technical Specifications”;

b) the construction of the Controlled Waste Storage Area (CWSA).
at/to Ballshi oil refinery, Ballshi, Albania where supplies are to be delivered, DDP (delivered duty paid, ICC Incoterms 2000), excluding the payment of VAT and all customs duties and taxes. The time limit for completion for the manufacture, delivery, installation, commissioning, maintenance of the supplies and the construction and commission of the works including the trial operation is 16 months from the signature of the contract by the latest party.

TERMS OF PARTICIPATION


8. Eligibility and rules of origin
Participation is open on equal terms to all natural and legal persons participating either individually or in a grouping (consortium) of tenderers of the Member States and the beneficiary countries and territories of the CARDS (see also item 21 below) programme (Albania, Bosnia-Herzegovina, Croatia, Former Yugoslav Republic of Macedonia and Serbia-Montenegro) and candidate countries for accession to the European Union (Bulgaria, Romania and Turkey). All goods supplied under this contract must originate in these countries.

9. Grounds for exclusion
Tenderers must submit a statement to the effect that they are not in any of the situations listed in point 2.3.3 of the Practical Guide to contracts procedures financed by the general budget of the European Communities in the context of external actions.

10. Number of tenders
Tenderers (including firms within the same legal group, other members of the same consortium, and sub-contractors) may submit only one tender for the lot. Tenders for parts of the lot will not be considered. Any tenderer may state in its tender that it would offer a discount in the event that its tender is accepted for more than one lot. Discounts for one lot only are not allowed. Tenderers may not submit a tender for a variant solution in addition to their tender for the supplies required in the tender dossier.

11. Tender guarantee
Tenderers must provide a tender guarantee of € 13,000.00 when submitting their tender. This guarantee will be released to unsuccessful tenderers once the tender procedure has been completed and to the successful tenderer(s) upon signature of the contract by all parties. This guarantee will be called upon if the tenderer does not fulfil all obligations stated in its tender.

12. Performance guarantee
The successful tenderer will be asked to provide a performance guarantee of no more than 10% of the amount of the contract at the signing of the contract. This guarantee must be provided no later than 30 days after the tenderer receives the contract signed by the Contracting Authority. If the selected tenderer fails to provide such a guarantee within this period, the contract will be void and a new contract may be drawn up and sent to the tenderer which has submitted the next best compliant tender.

13. Information meeting and/or site visit
A mandatory information meeting and site visit will be held on held on 26 August, 2005at 10:00 hr local time at Ballshi Oil Refinery in Ballsh, Albania to answer any questions on the tender dossier which have been forwarded in writing or are raised at the meeting. Minutes will be taken during the meeting and these will be communicated - together with any clarifications in response to written requests which are not addressed during the meeting - in writing to all the tenderers at the latest 11 calendar days before the deadline for submission of tenders. No further clarification will be provided after this date. All the costs of attending this meeting will be borne by the tenderers.
Any tenderers wishing to attend the clarification meeting above-mentioned shall submit a written confirmation containing a legible photocopy of the Identity Card or Passport of the person attending the meeting.These documents must be sent to the EC Delegation, Contracts, Finance and Audit Section, c/o Mrs. Maria Amália Baraona, Rruga Donika Kastrioti villa 42, Tirana, or by e-mail to maria-amalia.baraona@cec.eu.int (maria-amalia.baraona@cec.eu.int) at the latest on 19 August 2005.

The tenderers wishing to obtain the set of 26 designs on a CD in pdf format should indicate so in the above-mentioned written confirmation. The cost of the designs is a lump sum of 10 Euros which covers administrative and reproduction costs and should be deposited in a bank account to be indicated by the Contracting Authority at the latest on 23 August 2005 to all the tenderers attending the mandatory meeting. The tenderers purchasing the designs shall present a copy of the deposit in the mandatory meeting.

14. Tender validity
Tenders must remain valid for a period of 90 days after the deadline for submission of tenders.

15. Period of execution
16 months from the signature of contract by the latest party, including the trial period.

16. Deadline for submission of tenders
07 October 2005 before 15h00 local time.

Any tender received after this deadline will not be considered.

17. Tender opening session
10 October 2005 at 10h00 local time, at the premises of the EU Delegation in Albania, Rruga Donika Kastrioti villa 42, Tirana, Albania.

18. Legal basis
Council Regulation (EC) No.2666/2000 of 5 December 2000 as amended by the Council Regulation (EC) No. 2415/2001 of 10th December 2001.
