A vacancy has arisen in the Headquarters of the OSCE Presence in Albania for a Short Term Local Expert for Report Writing within the scope of the Rule of Law and Human Rights Department. This consultancy is envisaged to be on part-time basis for three months, starting in October 2012.
Background;
Within its Judicial Reform Project, the Rule of Law and Human Rights Department seeks to expand its activities to improving administrative dispute resolution. While the law establishing new administrative courts has been adopted in May 2012, in light of the applicable transitional provisions, no fixed date has been foreseen for the administrative courts to start functioning. Considering therefore the still pending status of these new administrative court proceedings, the administrative justice component of the Judicial Reform Project focuses on administrative cases within various State institutions. In fact, cases can be filed with the court only after an administrative route of complaint has been followed. Notwithstanding the different types, competencies, locations and jurisdictions of various State institutions dealing with administrative disputes, the procedure and rules to be observed are the same, enshrined in the Code on Administrative Procedures. The Presence will therefore conduct a pre-study of the legislation and institutional framework of administrative disputes in several central State institutions. The Presence has sent questionnaires to pre-selected central State institutions to be included in the pre-study, asking them to provide statistics on disputes registered and solved during the past and the current year. The information gathered during this pre-study will serve as basis for future projects on administrative justice.

Objective;
The Presence requires the services of a local administrative law expert to collect information and statistics from various pre-selected State institutions and write a pre-study on administrative dispute resolution mechanisms as applied by these State institutions.

Tasks:
The Presence will hire a part-time local expert for an estimated period of four months maximum to produce a pre-study on administrative dispute resolution. This pre-study will contain a descriptive and an analytical part and will focus on various State institutions dealing with administrative disputes.
• The expert will first study the legislation in force with regard to competencies of State institutions to deal with administrative disputes, on the basis of the documentation on functioning of pre-selected central State institutions, as provided by the Presence. He will then draft the descriptive part of the pre-study. This descriptive part will provide information on competencies of State institutions in charge of solving administrative complaints and means at their disposal to rule on these cases.
• The expert will conduct then research and hold meetings with the pre-selected State institutions in Tirana. The expert will visit these State institutions and ask them to provide further information on complaints received during the years 2011-2012 and the manner they deal with these complaints.
• On the basis of the information gathered, the expert will draft the second part of the pre-study, analysing statistics and assessing the effectiveness of the observed administrative dispute resolution mechanisms. The expert will also consult the previously contacted State institutions during the drafting process. The analytical component of this pre-study will provide directions for future projects in the administrative justice area.
The results will provide grounds for an objective assessment of the effectiveness of the relevant legislation and institutional framework.

Deliverables:

A pre-study on administrative dispute resolution mechanisms in the pre-selected State institutions is finalised by the end of December 2012.



Qualifications:
• University degree in law;
• At least 6 years of relevant working experience;
• Excellent knowledge of Albanian administrative law and procedure;
• Very good English writing skills and ability to draft reports in English;
• Ability to work with minimal supervision and under pressure;
• Prior experience working on judicial and/or administrative reform and rule of law programs in Albania will be an asset;
• Previous experience in academic research and publication or drafting of policy papers would be an asset.

Remuneration:
The Consultant will perform the tasks between for the time period October - December 2012.

For this part-time assignment, the proposed fee is a lump-sum of 2,800 Euro that will be paid in two instalments.
