A vacancy has arisen in the Headquarters of the OSCE Presence in Albania for a Local Consultant within the scope of the Rule of Law and Human Rights Department. This consultancy is envisaged to be on part-time basis for three months and a half, starting on 5 October 2012.

Background;
The Presence is currently implementing its Judicial Development Project, which seeks to improve the adjudication of civil cases by identifiying deficiencies in the conduct of civil proceedings, suggesting remedies to these deficiencies and deepening the professional knowledge of Albanian judges and lawyers. As a basis for its findings, the Presence has observed civil trials in four dristrict courts over a period of more than two years. Currently, a report detailing the observed problems is being finalised (the "Civil Trial Report"). The Civil Trial Report will provide some general recomendations for improving civil trials. In the next phase of the project, the Presence will turn these general recommendations into concrete ones, including suggesting text for legislative amendments, where required. A part-time local consultant will be hired to assist the Presence to perform this task.
Objective;
The Presence requires the services of one consultant/local expert to produce a report (the "Specific Recommendations Report") with specific recommendations for addressing the problems identified by the Civil Trial Report.

Tasks:
Under the supervision of, and in coordination with, the project manager of the Judicial Development Project, the consultant/local expert will be tasked to draft the Specific Recommendations Report. The Specific Recommendations Report will be drafted in English and will contain elaborated recommendations to amend both relevant legislation and court practices. Suggestions for legislative amendments must be accompanied by an explanatory memorandum (preparatory work). The deadline for the report is 20 January 2013. For this purpose, the consultant will perform the following duties during the period 5 October 2012 and 20 January 2013:
1. Consultation process:
(a) the consultant will draft a questionnaire on the general recommendations of the Civil Trial Report in consultation with the project manager;
(b) the consultant will meet with interlocutors from the judicial system, including the High Council of Justice, the Ministry of Justice, the School of Magistrate and the High Court based. Discussions among the consultant and interlocutors will be based on the questionnaire prepared by him;
(c) during his attendance of five roundtables to be organised by the Presence in Vlora, Gjirokastra, Korça, Lezha and Tirana, the consultant will gather and analyse the feedback received on the Civil Trial Report. In these seminars, the Presence will present the Civil Trial Report during five half-day sessions, thereby allowing judges, lawyers and other interested parties from all regions of the country to discuss the findings and general recommendations of the Civil Trial Report.
2. Drafting and compilation of the Specific Recommendations Report
(a) Based on the information gathered from the consultation process, the consultant will prepare an initial draft paper containing elaborated recommendations and submit the draft to the project manager by 20 December 2012.
(b) the consultant will incorporate potential comments on the draft from the project manager and/or Head of the Rule of Law and Human Rights Department.
(c) the consultant will deliver the final document by 20 January 2013 to the project manager.


Qualifications:
- Advanced university degree in law;
- At least 6 years of professional experience as a civil judge and/or lawyer in Albania;
- Excellent knowledge of Albanian civil law and procedure as well as international fair trial standards relevant to civil proceedings (especially Art. 6 of the European Convention of Human Rights and relevant case law);
- Very good English writing skills and ability to draft reports in English;
- Prior experience working on judicial reform and rule of law programs in Albania will be an asset;
- Previous experience in academic research and publication or drafting of policy papers would be an asset;
- Ability to work with minimal supervision and under pressure.

Deliverables:
- Submit a draft paper containing specific recommendations which address the problems identified in the Civil Trial Report by 20 January 2013. The paper shall annex all documents necessary for amending the existing legislation, including the explanatory memorandum and the new provisions.
- Submit the final paper with the recommendations to the project manager by 20 January 2013.

Remuneration:
The Consultant will perform the tasks between 5 October 2012 and 20 January 2013. The proposed fee is a lump-sum of 2500 Euro for a part-time assignment. The amount shall be paid upon submission of the final paper.

The consultant will also receive DSAs for the travel to Vlora, Gjirokastra, Korca and Lezha.
