Local Legal Consultant - Short-Term
Summarize Legal and Regulatory Framework for Health Facility/Hospital Autonomy in Albania
Scope of Work:
1. Review health care legislation, by-laws and regulations, decrees, orders, policies, and/or other relevant regulatory documents related to health facility/hospital autonomy and prepare a summary report in English that includes:
• General description of findings;
• Any identified legal or regulatory gaps;
• Identified barriers to health care facility autonomy;
• Identified contradicting legal statements within the existing laws, sub-laws and regulations
• Recommendations to address any gaps/barriers identified.
Interviews with key health sector stakeholders, including Ministry staff, hospital managers, finance and other authorities, may supplement the document review.
2. Formulate a definition of autonomy as it derives from the legal documentation*.
• Provide a comparative analysis of the legally defined autonomy and the applied level of autonomy (review the example of Durres hospital and describe discrepancies if any, as well as that of PHC entities in Albania).
• Provide a list of all regulatory documents reviewed in English and copies of the documents in Albanian (electronic copies preferred, if available).
* The definition of autonomy should include financial, managerial, clinical, and human resources dimensions (e.g., ability to shift budget funds across line items, ability to hire/fire staff, ability to procure medical products, etc.).
3. Review other legal and regulatory documents that govern the organization and registration of autonomous health care facilities/hospitals and prepare a summary report in English that includes: i) options for organization and registration; ii) steps in the process for each option; and ii) related costs (if any). Interviews with key government and/or business sector stakeholders may supplement the document review.
• Provide a list of all regulatory documents reviewed in English and copies of the documents in Albanian (electronic copies preferred, if available).
4. Revise and finalize summary reports as requested, based on the review of EEHR Project experts to address requests for clarifications, suggestions, comments, or edits.
Level of Effort and Period of Performance:
25 days
• Draft summary reports due no later than four weeks after start date
• Final summary reports due no later than six weeks after start date
Required Qualifications and Skills:
• Albanian law degree, with a minimum of 5 years of experience working as a lawyer in Albania
• Experience reviewing and summarizing legal, regulatory, and policy frameworks on key issues
• Experience and familiarity with health sector laws and regulations
• Proven verbal and written communication skills
• International experience strongly preferred
